General terms of service

1. Acceptance
Creating an outsend account or using the service constitutes acceptance of these terms of service (the "ToS"). In case of disagreement with any part of these ToS, the service must not be used.
2. Service description
outsend is a B2B prospecting SaaS tool. It lets users collect publicly available business data (Google Maps), enrich those records (emails, phones, company data, etc.), filter and export those lists, and set up periodic monitoring on that data.
3. GDPR roles and responsibilities
In accordance with the General Data Protection Regulation (EU 2016/679):
- outsend acts as a processor of the data collected by the user through the tool. The leads, records and enrichments collected by a user through outsend belong to that user and stay in their isolated workspace.
- The user acts as the data controller for the data they collect. They define the purposes, retention period, recipients, and ensure their commercial outreach complies with applicable regulations (GDPR, e-Privacy, CNIL, etc.).
- outsend is the data controller for its own operational data: user account (email, hashed password), technical logs, audit log, billing data.
4. User obligations
4.1 Account creation
Access to outsend is restricted to people who have received an invitation. The user provides accurate information when creating their account and keeps it up to date. They are responsible for keeping their password confidential and for any activity carried out from their account.
4.2 Prohibited uses
The following are strictly prohibited, on pain of immediate account suspension without notice or refund:
- Spam, harassment, mass sending of unsolicited messages in breach of GDPR, e-Privacy or CAN-SPAM
- Outreach to private individuals without a legal basis (prior consent required for B2C in France)
- Collection or use of sensitive data within the meaning of GDPR (health, political/religious views, sexual orientation, biometric data, etc.)
- Resale, public sharing or transfer to a third party of leads collected through outsend, unless explicit agreement with that third party and GDPR compliance
- Use of outsend for illegal, fraudulent activities or activities harming third parties
- Any attempt to bypass outsend's security measures or access other users' data
4.3 Outreach compliance
The user commits to respecting, when using the collected data:
- GDPR — legal basis of processing, information of data subjects, data subject rights (access, deletion, objection)
- The French Data Protection Act (Loi Informatique et Libertés)
- Article L.34-5 of the French Postal and Electronic Communications Code on electronic outreach
- CNIL recommendations on B2B outreach (in particular clear opt-out, sender identification, respect of objections)
outsend disclaims any responsibility regarding the use the user makes of the data collected through the tool.
5. Data ownership
The data collected by the user through outsend (scraping results, enrichments, filtered lists, notes, monitoring) remains the property of the user. outsend has no right to use this data other than:
- Storing it in the user's dedicated workspace
- Making it accessible to the user for consultation, modification, export
- Processing it at the user's request (filters, pipelines, enrichments, auto monitoring)
- Keeping technical usage logs for security and service improvement purposes
outsend explicitly forbids itself from:
- Sharing one user's data with another user
- Building a shared dataset from data collected by users
- Reselling any user data
- Training AI models on user data to resell or exploit elsewhere
6. Retention and deletion
User data retention is decided by the user. No automatic purge is applied by outsend as long as the account is active. The user can at any time:
- Export all their data from the Settings page → "My data"
- Delete their account and all associated data via the "Danger zone" of the Settings page
Account deletion is final and triggers the deletion of all data collected by the user, including stored CSV files. Only anonymized technical logs and billing data legally required are retained in accordance with regulations.
7. Service availability
outsend strives to ensure continuous service availability but does not guarantee 100% uptime. Interruptions may occur for maintenance, upgrades, or force majeure events. outsend disclaims any liability for occasional unavailability.
8. Intellectual property
All elements composing outsend (source code, interface, structural database, design, brand, documentation) are the exclusive property of outsend's publisher. No right is granted to the user other than that of using the service in accordance with these ToS.
9. Limitation of liability
outsend is provided "as is", without any warranty whatsoever. To the extent permitted by law, outsend shall not be held liable for any indirect damage, loss of profit, loss of data or business interruption arising from the use of the service. outsend's total liability shall not exceed the amount paid by the user in the 12 months preceding the triggering event.
10. Changes to the ToS
outsend may modify these ToS at any time. Users will be notified of substantive changes via their registered email address or by a notification in the application. Continued use of the service after notification constitutes acceptance of the amended ToS.
11. Termination
The user may terminate their account at any time via the Settings page. outsend reserves the right to suspend or terminate an account in case of breach of these ToS, with or without notice depending on the severity.
12. Governing law
These ToS are governed by French law. Any dispute relating to their interpretation or execution will be submitted to the competent courts of the Paris Court of Appeal jurisdiction.
